それは間違った法解釈。日本が当時批准していたハーグ陸戦条約（Laws and Customs of War on Land)
によると、捕虜は俘虜（Prisoners of war)として色々と権利が書かれているが、
それとは別に特別条項というのがあり、
Art. 23.
23条 特別の条約により規定された禁止行為以外に、特に下記の物を禁ずる。
In addition to the prohibitions provided by special Conventions, it is especially forbidden -
兵器を捨てた自衛手段を持たない投降者を殺傷すること
To kill or wound an enemy who, having laid down his arms, or having no longer means of defence, has surrendered at discretion;
助命しないことを宣言すること
To declare that no quarter will be given;
相手国国民の権利消滅、停止、裁判の不受理の宣言をすること
To declare abolished, suspended, or inadmissible in a court of law the rights and actions of the nationals of the hostile party.
Art. 30.
30条 スパイの現行犯は裁判を経て罰しなければならない。
A spy taken in the act shall not be punished without previous trial.
とある。
