正確にはその認識がウソ。
商標ってのは、「問題になるような偽物で」「商売」か「商売の妨害」をして、
初めて問題になるもの。
厳密には、誰それの商標ですとか書く義務は法的には存在しない一方
（ふつうに見て明らかに問題がなければ）、
UN*X みたいな表記のほうこそ、商標を正しく記述しないということで、
問題がある。
