The Japanese responded "we will not accept any help nor cooperation from the Sea Shepherd who has been harassing
our research vessels".

The operators of a Japanese whaling vessel have accused anti-whaling ship the Sea Shepherd of disrupting the search for a missing sailor.

The 30-year-old engine room worker disappeared more than two days ago from the spotter ship in the Southern Ocean.

A spokesman for the ship's operators, Glenn Inwood, says the Sea Shepherd did not respond to initial calls for help,
falsely claiming it was not in the area.

Mr Inwood says the Sea Shepherd refused to respond to a distress signal sent when the man went missing.

because they were heading to Hobart," he said.

Greens leader Bob Brown said Ms Gillard's refusal to rule out denying permission for the Steve Irwin to dock in Hobart was "unbelievable".

現在、スティーブ・アーウィン号の灯火or無灯火論争と、日本からの寄港阻止要請の是非と、二つの論点が
入り乱れてるようです。下記ニューサイエンティスト誌の記事の場合、週刊誌のせいかタイムラグがあって、
幸か不幸か、乗員行方不明、灯火／無灯火の論点には触れておらず、捕鯨協会の入港拒絶要請だけに焦点が
あたってます。
スティーブ・アーウィン号に違法行為があった可能性はあるわけですが、だからといって給油のための
寄港阻止ができるかどうかというのは、法治主義にかかわる問題でしょう。
この船には、シーシェパードの行動に直接責任を負うわけではないTV番組制作チームや、士官ではない
スタッフも乗船しているわけで、寄港拒否要請というのはあまりにも法治主義を無視した無謀な主張でしょう。
（近頃の日本の論調だったら、即座に＜内政干渉だ＞という大合唱になるケースじゃないですかね。）
港湾への自由寄港の権利というのは「公海の自由」を具体的に裏付ける古典的に重要な権利なわけで、当該船に
違法行為の疑いがあれば、責任者だけを拘束し裁判にかければ良いわけで、他の乗員の自由権を毀損し、
大海に放置しておくという権利はどこの主権国家にも無いはずです。
去年の１月に共同船舶に対して出された豪州連邦裁判所の判決については、日本側は外務省も共同船舶も
最初の訴状の受取から拒否しているわけで、捕鯨問題に関しては、日本側は何か重大な法認識の崩壊現象を
起こしているのではないかと考えられます。

TENSIONS are rising in the Antarctic following skirmishes last month between anti-whaling protesters and Japanese vessels
they accuse of commercial whaling under the guise of research.

This week, Keiichi Nakajima, head of the Japan Whaling Association, called on the governments of Australia and New Zealand

"criminal acts" and endangered lives. Failure to do so, he said, would make them "complicit" in any further attacks. Australia has
agreed to consider Japan's request.

この事件は、1993年 2月 3日に発生しました。
オーストラリア南方海域で、フランス船籍の船から救難信号が出されました。
これを受けてオーストラリアのコーストガードが周囲の船舶に情報を求めるテ
レックスを打ち、無線（衛星海事電話インマルサットを含む）で協力要請を行
いました。
しかし、遭難船舶から一番近くにいた捕鯨船団は、応答をせず、指名の問い
合わせに対しても位置を知らせず、救援を行わなかった、というのが事件の概
要です。結局、救援には、ロシアの砕氷船と、調査捕鯨への抗議行動のために
南極海にいたグリーンピース号が向かいました。グリーンピース号よりも捕鯨
船団の方が、近く、また遥かに足が早い船だったのですが。
幸いなことに、救難信号は間違って発信されたもので、海難事故には至らな
かったとのことです。
この事件について、「クジラを捕って、考えた」に記載されている日本側の
考えは、要するに「グリーンピースに船の位置を知られたくなかったため、位
置の開示はできなかった」「遭難船に一番近くにいたのが自船だということに、
しばらく気付かなかった」ということのようです。「グリーンピースを恐れる
あまり、判断が狂った」というような説明もあります。
また、翌日になってから、ようやくキャッチャーを１隻救援に差し向けると
いう申し出をしたようですが、時すでに遅し、オーストラリアからは「必要な
い」との返答を受け、その船は船団に戻っています。
